General Terms and Conditions (GTC) of Speedprint Vienna – for private customers

1. scope of application
These General Terms and Conditions apply to all orders, deliveries and services of Speedprint Vienna to private customers (consumers within the meaning of the Consumer Protection Act – KSchG). By placing an order, the customer agrees to these terms and conditions.

2. services
Speedprint Vienna provides services in the field of digital printing, copying, binding, finishing as well as dispatch and delivery of print products. The presentation of products and prices on the website does not constitute a legally binding offer, but a non-binding invitation to order.

3. conclusion of contract
A contract is concluded as soon as Speedprint Vienna confirms an order in writing (e.g. by e-mail) or verbally or begins with the execution of the service.

THE CUSTOMER IS OBLIGED TO CHECK THE DATA AND DOCUMENTS PROVIDED BY HIM CAREFULLY FOR ERRORS BEFORE TRANSMISSION.

Technical color or material deviations are possible and do not constitute a defect.

4. prices and payment
All prices are in euros and include VAT. Payment shall be made in cash or by card on collection. In the case of delivery, advance payment or payment on delivery is required, unless otherwise agreed.

5. delivery and collection
Ordered products can be collected from the business premises (Theobaldgasse 15, 1060 Vienna) or – by arrangement – delivered by courier or shipping service (e.g. post, GLS). The shipping costs are shown separately. Delivery dates are non-binding unless a fixed date has been expressly agreed in writing.

6. retention of title
The goods remain the property of Speedprint Vienna until full payment has been made.

7. warranty and complaints
Speedprint Vienna produces print products according to the data provided by the customer.

NO LIABILITY IS ACCEPTED FOR ERRORS THAT ARE DUE TO INCORRECT OR INCOMPLETE CUSTOMER DATA, UNCLEAR PRINT APPROVALS OR LACK OF CONTROL OF PREVIEWS.

Obvious defects must be reported in writing immediately, but at the latest within 5 working days of receipt of the goods. If the complaint is justified, a replacement delivery or credit note will be issued. Further claims, in particular for damages, are excluded unless gross negligence is involved.

8. right of withdrawal
In accordance with § 18 para. 1 no. 3 FAGG, there is no right of withdrawal for goods that are manufactured according to customer specifications or clearly tailored to personal needs. This applies in particular to individually printed products.

9. data protection
Personal data is processed exclusively within the framework of the statutory provisions and is not passed on to third parties unless this is necessary for the fulfillment of the contract (e.g. to shipping service providers).

10. place of jurisdiction and applicable law
Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For all disputes arising from or in connection with contracts between the customer and Speedprint Vienna, the competent court in Vienna shall have jurisdiction to the extent permitted by law.

11. final provisions
Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. Amendments and supplements to these GTC must be made in writing.

 

General Terms and Conditions (GTC) of Speedprint Vienna – for business customers

1. scope of application
These General Terms and Conditions apply to all offers, deliveries and services of Speedprint Wien to business customers (entrepreneurs within the meaning of the Austrian Commercial Code – UGB). Deviating or supplementary terms and conditions of the customer shall only become part of the contract if they are expressly recognized in writing by Speedprint Wien.

2. services
Speedprint Vienna offers services in the field of digital printing, copying, binding, finishing as well as dispatch and delivery of printed products. Illustrations, samples, prices and descriptions on the website or in offers are non-binding and do not constitute a legally binding offer, but an invitation to order.

3. conclusion of contract
A contract is concluded as soon as Speedprint Vienna confirms an order in writing (e.g. by e-mail) or verbally or begins with the execution of the service.

THE CUSTOMER IS OBLIGED TO CHECK THE DATA AND DOCUMENTS PROVIDED BY HIM CAREFULLY FOR ERRORS BEFORE TRANSMISSION.

Changes or additions require written confirmation by Speedprint Vienna. Technically caused color or material deviations that are within the industry-standard tolerances are not considered defects.

4. prices and payment
Unless otherwise stated, all prices quoted on the website are inclusive of statutory VAT. The following applies to business customers: The net amount plus the applicable statutory VAT is shown on the invoice. Terms of payment:
– Upon collection, payment can be made in cash or by card.
– Alternatively, payment on account with 14 days payment term from the invoice date without deduction is possible, subject to approval by Speedprint Vienna.
In the event of late payment, Speedprint Vienna is entitled to charge statutory default interest in accordance with § 456 UGB as well as reminder and collection charges.

5. delivery and collection
Printed matter can be collected from the business premises (Theobaldgasse 15, 1060 Vienna) or delivered by courier or shipping service (e.g. post, GLS) by arrangement. The shipping costs shall be shown separately and shall be borne by the customer. Delivery dates are non-binding unless a fixed date has been expressly agreed in writing. The risk is transferred to the customer when the goods are handed over to the transportation service provider.

6. retention of title
The goods remain the property of Speedprint Vienna until full payment of all claims arising from the business relationship.

7 Warranty and liability
The customer is obliged to inspect the delivered goods immediately upon receipt. Obvious defects must be reported in writing within 5 working days, otherwise the delivery shall be deemed approved.

SPEEDPRINT VIENNA ACCEPTS NO LIABILITY FOR PRINT DATA, TEMPLATES OR APPROVALS PROVIDED BY THE CUSTOMER.

In the event of a justified complaint, Speedprint Vienna shall, at its discretion, provide a replacement delivery or credit note. Further claims, in particular for damages, are excluded, unless gross negligence is involved.

8. data protection
Speedprint Vienna processes personal data exclusively within the framework of the applicable data protection laws. Data will only be passed on to the extent necessary to fulfill the contract (e.g. to shipping or payment service providers).

9. place of jurisdiction and applicable law
Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of performance and exclusive place of jurisdiction is Vienna, insofar as legally permissible.

10. final provisions
